On Friday, March 27, the United States Court of International Trade issued an amended order directing U.S. Customs and Border Protection to reliquidate all entries where liquidation is considered final, excluding any International Emergency Economic Powers Act (IEEPA) tariffs.
In practical terms, this means that Customs and Border Protection is legally required to refund all IEEPA tariffs, regardless of the liquidation status of the entries.
The court’s order is limited in scope and does not extend to other customs-related provisions. The order does not address any issues related to duty-free de minimis treatment under 19 U.S.C. § 1321.
