Heartland, Cruiser Seek Injunction Against Axiom RV
According to a report from The Elkhart Truth, two RV makers have taken legal action against a newly launched company and a former employee.
Heartland RV and Cruiser RV together are seeking an injunction against Axiom RV and a former CRV general manager, John Jones. The two THOR brands claim that Jones took confidential business information when his employment was terminated in November and that he used the information to contact HRV and CRV customers or otherwise engage in unfair competitive practices.
“Jones’ actions were done willfully and maliciously, with the deliberate intent to injure HRV and CRV and with a conscious disregard of HRV and CRV’s rights and protections of their confi dential information,” alleges the complaint, which was filed May 28 in Elkhart County Circuit Court. “Unless restrained and enjoined, Jones will continue to misappropriate HRV and/or CRV’s confidential information.”
Jones signed a non-competition and non-disclosure agreement when he was hired in 2019, according to the complaint for injunction and damages. He was prohibited from using confidential company information, solicit CRV or HRV customers or otherwise compete with the companies for one year after leaving, the complaint states.
Axiom RV was founded by Jones as well as two other former executives at HRV and CRV, according to an article on the company’s launch published May 2 in RVBusiness. Nexus RV, which is also named in the court action, will “share the same business partners and certain backend services” as Axiom but the new manufacturer will be independently operated, the article states.
