RVIA: Nebraska RV Franchise Law Is Now in Effect

On Thursday, Oct. 1, Nebraska’s new RV franchise law took effect. Earlier this year, the Nebraska Legislature passed the law by a 48–1 vote. The new RV franchise law establishes a framework specifically for the manufacturer-dealer relationship within Nebraska’s RV industry and is based on the model law supported by the RV Industry Association (RVIA) and RV Dealers Association (RVDA).

Now that the law is in effect, RV manufacturers and dealers should be familiar with its key provisions, including requirements for written manufacturer-dealer agreements, termination and repurchase, transfers and succession, warranty responsibilities, pre-delivery inspections, indemnification, mediation and penalties.

The law also makes several important changes specific to the RV industry in Nebraska. It defines the types of RVs covered, increases the maximum allowable length of fifth-wheel trailers to 46 feet, removes van conversions from the definition of an RV, and updates the reference to the 2025 ANSI A119.5 Park Model RV Standard.

The law was developed through collaboration among RVIA, Nebraska RV dealers and the Nebraska New Car and Truck Dealers Association. With the law now in effect, Nebraska RV manufacturers and dealers should review their agreements and business practices to ensure they are aligned with the new requirements.
